ILLINOIS SECRETARY OF STATE HEARING REQUIREMENTS
The rules of the Secretary of State, Department of Administrative Hearings, require that certain documentation be presented at the time of a hearing in order to be considered for driving relief (Restricted Driving Permit (RDP) and/or Reinstatement). These documents are required regardless of when the DUI(s) occurred.
This form can be used as a guide to help you prepare for your upcoming Hearing. It is important to be completely prepared for you hearing as a single continuance is only granted for good cause. Due to heavy case loads, when a continuance is granted, it is generally for 60 days. Please also note that you must have NO TICKETS pending at the time of your hearing.
GENERAL DOCUMENTATION REQUIREMENTS
You must complete an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA) licensed agency to determine your classification level.

Classified Minimal Risk (Level I)
- Must submit an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA license agency.
- Must also submit an updated evaluation if Uniform Report or any subsequent update evaluation is more than six months old from the date of hearing. An update must be prepared by the agency that completed your uniform report.
- Must document completion of DUI Risk Education Course (formerly known as remedial).

Classified Moderate Risk (Level II)
- Must submit an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA license agency.
- Must also submit an updated evaluation if Uniform Report or any subsequent update evaluation is more than six months old from the date of hearing. An update can be prepared by the agency that completed your Uniform Report, or the agency that completed your primary treatment.
- Must document completion of DUI Risk Education Course.
- Must document completion of Early Intervention Program.
- Must document completion of any substance abuse treatment that was recommended by a Licensed Treatment Provider.

Classified Significant Risk (Level II)
- Must submit an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA license agency.
- Must also submit an updated evaluation if Uniform Report or any subsequent update evaluation is more than six months old from the date of hearing. An update can be prepared by the agency that completed your Uniform Report, or the agency that completed your primary treatment.
- Must document completion of DUI Risk Education Course.
- Must document completion of any substance abuse treatment that was recommended by a Licensed Treatment Provider.
- Must include a copy of the Individualized Treatment Plan.
- Must include a copy of the Discharge Summary.
- Must include a copy of the Aftercare/Continuing Plan.
- Must include a copy of the Continuing Care Status Report.

Classified High Risk (Level III) – Dependent
- Must submit an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA license agency.
- Must also submit an updated evaluation if Uniform Report or any subsequent update evaluation is more than six months old from the date of hearing. An update can be prepared by the agency that completed your Uniform Report, or the agency that completed your primary treatment.
- Must document completion of any substance abuse treatment that was recommended by a Licensed Treatment Provider.
- Must include a copy of the Individualized Treatment Plan.
- Must include a copy of the Discharge Summary.
- Must include a copy of the Aftercare/Continuing Plan.
- Must include a copy of the Continuing Care Status Report.
- Must provide proof of establishment of support/recovery program (Alcoholics Anonymous, Counseling, church, etc.) and abstinence as follows:
- Must submit at least 3 letters from fellow members/participants, attesting to your active involvement in your support program.
- Must submit at least 3 letters from individuals (friends, family, etc.) who can attest to abstinence from alcohol and drugs for a period of at least 12 months if seeking reinstatement, but no less than 6 months for a restricted driving permit.

Classified Minimal Risk (Level III) – Non-Dependent
- Must submit an Alcohol/Drug Evaluation Uniform Report completed by an OASA (formerly DASA license agency.
- Must also submit an updated evaluation if Uniform Report or any subsequent update evaluation is more than six months old from the date of hearing. An update can be prepared by the agency that completed your Uniform Report, or the agency that completed your primary treatment.
- Must document completion of any substance abuse treatment that was recommended by a Licensed Treatment Provider.
- Must include a copy of the Individualized Treatment Plan.
- Must include a copy of the Discharge Summary.
- Must include a copy of the Aftercare/Continuing Plan.
- Must include a copy of the Continuing Care Status Report.
- Must submit at least 3 letters from individuals (friends, family, etc.) who can attest to what your current drinking pattern is.
- Must submit an additional report from the treatment provider explaining how dependency was ruled out. This requirement cannot be waived.
