There is no Spousal Support calculator in Illinois.  Alimony is decided by a judge after a careful review of numerous factors.  Illinois divorce law is written in the Illinois Marriage and Dissolution of Marriage Act which requires the judge to consider:

  • Both your and your spouses income, including the property awarded to each of you in the division of property, as well as the non-marital property of each of you;
  • The financial needs of each of you;
  • If one of you put off education or a career in order to raise children born of the marriage, the judge must consider any loss of earning capacity as a result of that sacrifice;
  • The length of time it will take either of you to get more education, training, or seek employment;
  • Whether the spouse who requests alimony can become self-supporting;
  • The length of the marriage;
  • The standard of living during the marriage;
  • The age and physical and emotional condition of both spouses;
  • Tax consequences arising out of the property division;
  • Whether the party requesting alimony supported the other spouse during the time that spouse pursued an education, career, or licensing;
  • Whether you had a maintenance agreement in the case of a divorce, or during the negotiation of the divorce;
  • And, any other factor the judge believes is necessary to consider in order for the alimony award to be just and equitable.

Noticeably absent from this list of considerations is the misconduct of you or your spouse.  In fact, Illinois law specifically prohibits a judge from considering marital misconduct when in the alimony calculations.
